Who Determines Just Compensation?

In all eminent domain cases, the compensation due the property owner shall be assessed by a jury. Ohio Const. art. I, § 19. The number of jurors to which the parties are entitled depends on whether the land is sought to be condemned by a public, i.e., governmental, or private entity. Condemnations by public entities are entitled to eight jurors, as is the general rule for civil cases in Ohio. Ohio Civ.R. 38. Condemnations by private entities, however, are entitled to twelve jurors. Ohio Const. art. XIII, § 5.
